Terms of Use for Scoot Generative AI-Powered Features

These Terms of Use apply to the conversational experience on, and your use of any Artificial Intelligence ("AI") powered generative experiences ("Services") on Scoot Airlines platforms, which may include but is not limited to Services on the Scoot Airlines web site, mobile application, or offered by Scoot Airlines on third-party platforms, websites or applications that Scoot Airlines has been integrated with (collectively, "Websites"), including experiences such as the search engine ("Search Engine") and M.A.R.V.I.E. Chatbot Service ("MARVIE").

The Services are intended to assist with providing generative AI functionality for users of Scoot Airlines Websites. By using any of the Services, you agree to the terms below:

1. Using the Services

The Services allow you to submit text inputs (“Input”) and text and image content output (“Output”) will be generated based on the Input. Input and Output are collectively “Content”. By using the Services, you confirm that you understand and agree to these Terms of Use. You must use the Services and the generated Content only (i) in a lawful manner and in compliance with all applicable laws; (ii) in accordance with these Terms of Use, or other documentation directed to the Services; (iii) in a manner that does not infringe or attempt to infringe, misappropriate or otherwise violate any rights of Scoot Airlines or its affiliates (collectively, “Scoot”).   

You may cease use of the Services at any time. If you do not wish to use the Services, you may choose not to utilise or engage with the Search Engine, MARVIE or any other AI-powered features on the Websites.

2. Ownership Rights

(a) The Content. All Content and materials within the Services (except Content which you provide), including but not limited to text, images, charts, forms, and logos, are the exclusive property of Scoot or licensed parties. Use of the aforesaid Content and materials without prior written approval from Scoot or relevant parties constitutes copyright infringement and other intellectual property rights violations, as the case may be.

(b) Similarity of Content. Due to the nature of machine learning, the Output may not be unique across users and the Services may generate the same or similar Output for other users. Other users may also ask similar questions and receive the same, similar or different responses.

(c) Use of Content to Improve Services. Scoot may use Content that you provide to or receive to develop or improve the Services. If you do not wish for Scoot to use Content that you provide for this purpose, you may choose not to utilise or engage with the Search Engine, MARVIE or any other AI-powered features on the Websites.

(d) Accuracy. AI and machine learning are rapidly evolving fields of study. Scoot is constantly working to improve the Services to make it more accurate, reliable, safe and beneficial. Given the probabilistic nature of machine learning, use of the Services may in some situations result in: (i) incorrect Output that does not accurately reflect real people, places, or facts or which is not applicable to your Input; or (ii) Output which does not precisely meet your expectations. This is the case even for Outputs generated after the Services determine that they are unable to generate appropriate Output based on your Input, and prompts you to rephrase your Input. You should evaluate the accuracy and sufficiency of any Output as appropriate for your use case, including by using human review of the Output. You should not use any Output for any purpose that could have a legal or material impact on a person and which requires professional expertise, such as making decisions on medical-related issues or in emergencies.

3. Usage Requirements

(a) Use of the Services. You may access, and Scoot grants you a non-exclusive right to use, the Services in accordance with these Terms of Use. You will comply with these terms and all applicable laws when using the Services. Scoot owns all rights, title, and interest in and to the Services.

(b) Feedback. Scoot appreciates feedback, comments, ideas, proposals and suggestions for improvements. If you provide any of these things, Scoot may use it without restriction or compensation to you.

(c) Restrictions. You may not (i) use the Services in a way that infringes, misappropriates or violates any person’s rights; (ii) reverse assemble, reverse compile, decompile, translate or otherwise attempt to discover the source code or underlying components of models, algorithms, and systems of the Services (except to the extent such restrictions are contrary to applicable law); (iii) use Output from the Services to develop models that compete with Azure OpenAI; (iv) except as permitted through the API, use any automated or programmatic method to extract data or Output from the Services, including scraping, web harvesting, or web data extraction; (v) represent that Output from the Services was human-generated when it is not or otherwise violate these Terms of Use; and (vi) copy, reproduce, modify, distribute or market any part of the Services or its content without Scoot’s prior written consent.

(d) Third Party Services. Any third party software, services, or other products you use in connection with the Services are subject to their own terms, and Scoot is not responsible for third party products.

4. User Data

To ensure the security of user information, you agree not to use any software, tools, or other means to interfere with the Services’ operations or to unlawfully collect, use or disclose user data. You acknowledge and agree that where your Input contains any personal data which can identify an individual, that you have either obtained their consent or are fully authorised to disclose their personal data to us for our purposes as disclosed in these Terms of Use and/or in our Privacy Policy.

5. Use of Content

You may only use the Content within these Terms of Use for lawful and proper purposes. You agree to be responsible for all matters arising from your use of the Services on the Websites. Further, you agree:

  • Not to use the Services on the Websites in any manner which breaches any other terms you have agreed to (such as the Scoot Airlines web site Terms of Service), applicable law or regulation or causes or which may cause an infringement of any third party rights;
  • Not to share, post, transmit or disseminate any Content derived from or information on or via the Websites which may be inaccurate, untrue, outdated, harmful, obscene, defamatory or illegal or create liability on Scoot’s part;
  • Not to interfere or attempt to interfere with the operation or functionality of this Web Site; and
  • Not to obtain or attempt to obtain unauthorized access, via whatever means, to any of Scoot’s systems.

6. Termination

Scoot reserves the right to terminate your use of the Services at any time if there is reasonable belief that you have violated these Terms of Use. Termination may occur without prior notice and may result in the loss of data or personal information.

7. Disclaimer of Liability

Any Content generated by the Services is provided “as is”, with no warranty of accuracy, availability or reliability. Scoot makes no warranty of, and assumes no liability for, any Content so generated by the Services. You acknowledge and accept that:

  • it is your responsibility to ensure that any Content so generated by the Services is used in a correct, appropriate and responsible manner;
  • you have obtained all relevant and necessary authorisations or consents to disclose personal data in your Inputs, in accordance with Section 4 above;
  • you will not rely on Outputs as a sole source of truth or factual information;
  • you will not rely on Outputs as a replacement or substitute for professional advice (including but not limited to advice on medical-related issues or other emergencies); and
  • you shall be fully liable and responsible for any use of Content from our Service.

Under no circumstances will Scoot be liable for any direct, indirect, punitive, exemplary, special or consequential damages that result from your non-compliance with these Terms of Use, and the access to, reliance upon, use of, or the inability to use, the Content on the Services on the Websites.

In the event of any conflict of the Content and any other Scoot terms and conditions, terms of use and/or polices existing at the time, the relevant Scoot terms and conditions, terms of use and/or polices shall prevail and supersede the Content.

8. Changes to the Terms of Use

Scoot has the right to change these Terms of Use at any time. Such changes will be effective immediately upon being published on the Web Site.

By continuing to use the Services after such changes, you indicate your acceptance and agreement to abide by the new Terms of Use.

9. Applicable Law and Jurisdiction

The law applicable to these Terms of Use is the law of the Republic of Singapore and the courts of the Republic of Singapore will have exclusive jurisdiction in case of any dispute.
